A New York judge on Friday permitted Donald Trump to seek dismissal of his hush money case, with his lawyers arguing the charges create “unconstitutional impediments” to his presidency.
Trump, 78, was convicted earlier this year, but prosecutors recently requested a delay in proceedings until after his presidential term begins on January 20.
“The case must be dismissed,” Trump’s lawyers claimed, arguing it interferes with his ability to govern. Prosecutors, while opposing dismissal, agreed Trump should have time to argue his case. Justice Juan Merchan set deadlines of December 2 for Trump’s motion and December 9 for the prosecution’s response.
