The United Kingdom’s Supreme Court unanimously ruled on Wednesday that, under the law, a woman is defined as someone born biologically female. The ruling has far-reaching implications, as it excludes transgender women from the legal definition of a woman in certain contexts under the U.K. Equality Act.

According to the five justices of the court, this interpretation allows for the exclusion of transgender women from some single-sex spaces and services, including changing rooms, homeless shelters, swimming areas, and medical or counseling services designated specifically for women. The court emphasized that even transgender individuals with a legal certificate recognizing them as female should not be considered women for the purposes of single-sex exceptions in equality law.

However, Justice Patrick Hodge, delivering part of the ruling, underscored that the judgment does not erase existing protections for transgender individuals. “This does not remove protection from trans people,” he said, noting that transgender individuals remain “protected from discrimination on the ground of gender reassignment.”

The decision is expected to spark both legal and political debate across the country, as lawmakers, advocacy groups, and communities grapple with the implications of the court’s interpretation of gender and equality rights.
